  • Property location
  • Property type and size
  • Type of development being planned

While the process may seem inconvenient, obtaining the proper permits protects both your investment and the environment. When speaking to contractors, be aware that a contractor saying “Yes” to everything you want done may not be in your best interest. Any code violations are the responsibility of the property owner, not the contractor. That is why it is important that before starting any land clearing project, take the time to check with local authorities. A quick phone call could save you thousands of dollars in fines and restoration cost, as well as weeks of frustration.

Factors that Determine if you Need a Permit

Location of Your Property

Each municipality has its own rules about land clearing. In Florida, there are some areas that require permits for even small projects. In our service area, there are two municipalities that do not allow any motorized clearing equipment on a vacant lot without a building permit – Yes that includes a lawnmower!

Most of our service area only requires permits for:

  • Removal of mature trees
  • Breaking the natural surface of the property (root-raking, stump removal, etc.)

Type of Land Being Cleared

As a property owner, it is important to know what the zone and classification designations are for your property. Zoning is a term for land use in a specific area. Common zone designations are: Single-Family Residences, Multi-Family Residences, Commercial, and Agricultural. Property classifications are a system used for tax assessment purposes. For example, a five-acre property zoned Agricultural may have a single-family residence with livestock. The classification may break down into a Homestead Exemption on the residence with an agricultural classification on the remaining four acres. In this instance, the two classifications will be taxed separately according to their specific municipality and also would have separate rules for clearing. Potential issues to consider are:

  • Wetlands: Clearing wetlands is highly regulated and usually requires special permits. In addition to the wetlands being protected, there is normally a wetlands buffer of 20 to 50 feet (the later normally applied when wetland area includes a lake). Check your property on the National Wetlands Inventory Map
  • Gopher Tortoise(s): Gopher turtles and their burrows are protected. Clearing land with gopher tortoise(s) present is possible. However, developing the land may require additional permits and care to not disturb the tortoises’ habitat (even when a tortoise is not present in burrow).   • Protected Trees: Most municipalities have a list of protected vegetation that isn’t necessarily within the area of a wetland.

Where the Permit Process Starts

  • Local Building Department: They can confirm which permits are required for your specific address. Typically, unincorporated counties are less restrictive than incorporated cities.
  • Environmental Services: Especially important if your land has wetlands, streams, or protected vegetation and/or animals.
  • HOA (if applicable): Some homeowners’ associations have rules about vegetation removal.
